WHY IT MATTERS MORE IN ILLINOIS
What changed in Illinois
Four things every Illinois funeral director should know.
THE LAW
Public Act 103‑0907
(SB2643)
The Integrity in Death Care Act.
Codified at 225 ILCS 41/15-56
for funeral establishments and
410 ILCS 18/35(o) for crematory
authorities. In force January 1,
2025.

THE RULES
68 Ill. Adm. Code
1250.240
In force December 10, 2025.
Sets what must be recorded,
requires five years of records,
and permits electronic or paper
systems the Department can
audit.
THE PENALTY
Class 4 felony
For intentionally or knowingly
violating the chain of custody
record requirements.
Falsification is not required.
Disciplinary fines reach $10,000
per violation.

THE CLOCK
10 business days
IDFPR must inspect within ten
business days of a complaint
alleging mishandling or
misidentification of remains.

Illinois is one of only four jurisdictions in North America whose law mandates a full identification and custody system for funeral establishments
generally.
10
BUSINESS DAYS
The law
10
MINUTES
Our benchmark
THE TWO TENS
Ten business days is the law. Ten
minutes is our benchmark.
When IDFPR receives a complaint alleging mishandling or misidentification, it
must inspect within ten business days. Whatever records exist that day are
what will be examined. No Illinois rule sets a time limit for producing a record.
Our benchmark is stricter on purpose: pull any case file from the past six
months and produce its full custody chain in under ten minutes. If you can't, the
checklist shows where to start.

IF YOU CONTRACT YOUR REMOVALS
Your custody chain doesn't stop at your door.
The duty runs through final disposition, not to the point of transfer. It
still applies when someone else is driving.
The rule requires identification verified on every transfer to and from a
separately owned funeral business, with both businesses' identifiers
recorded. A handoff with no confirmation of receipt coming back is a
gap in your chain.
The checklist covers every transfer point the rule names.
What firms on MorTrack tell us
“
If a question ever arises, we aren't relying on someone's memory or trying to piece together different records after the fact. We have a clear history of that person's care.
Jeff Hagel, President
McInnis & Holloway Funeral Homes. 10 locations, approximately three years on MorTrack.
“
As a funeral director, I must always keep track of my
removal techs and their locations. MorTrack is a great
tool that allows me to monitor the site and status of
cases in progress.
Johanna B., Funeral Director
Final Passage
MorTrack sits alongside your funeral management system and records every custody event automatically.
It does not guarantee compliance, and no software can. It closes the documentation gaps the checklist
finds.
